First: What is notarization?
Notarizaion is a legal, codified method of fraud deterrent. It includes a three part process performed by a certified public official know as a Notary Public. These processes, in short, are:
Vetting – verifying that the person signing and/or affirming or swearing is who they say they are.
Certifying – signing by the Notary alongside their affixed seal that they vetted and witnessed the signing and/or heard the oath or affirmation.
Record Keeping – Maintaining a journal or notes, either hard coped or digital with the details of the notarization in case it is revisited.
A duly appoined, impartial Notary Public ensures that a document is authentic, that the signature is genuine and that the signer or affiant acted without being under duress or intimidation.
What are the basic Notarial Acts catagories?
Most Notarial Acts in North Carolina fit in one of three catagories.
Acknowledgments – This is the most common Notarial Act. In it the Notary verifies that the signer is who they say they are and signed the document voluntarily.
Jurats aka Oaths or Affirmations – This is when a person swears to or affirms the truthfulness of a written statement by signing in front of a Notary who has verified their identity and that they swore or affirmed thatthe statement is true. However the Notary does not and can not swear or affirm to the truthfulness of the statement, just that the signer swore to it and signed in front of the Notary.
Verification or Proof – This is a sort of combination of an Acknowledgment and an Oath Affirmation when a third party or parties appears before the Notary and swears that they personally witnessed the signing of a document by an individual, not present, that signed a document. The Notary verifies the identity of the person swearing to have withnessed the individual signing the document but not the identity of the person that originally signed the doument in question.

NOTARY SIGNING AGENT
A Notary Signing Agent is a Notary that is trained to deliver, present and facilitate the voluminous number of signatures required on most loan and real estate closing transactions. They are NOT attorneys and are not loan officers. They are impartial notaries who will notarize documents in the closing or loan packet requiring notarization but will not give legal advice in any manner. They are not paid to be notaries but to collect documents already prepared, transport them to the closing, present them to the principal(s) with indications of where they need to be signed, notarize those signatures required after vetting identities, collect said paperwork, make copies and transmit copies and originals to the institution in the manner the institution mandates. Yes because of the notarizations they are required to be notaries but they are not paid for being a notary but for being a closing paperwork faciltator who can notarize.
It is necessary that a Notary be disciplined, familiar with the types of documents, neat and responsible with the transport and return of documents. Tucker Notary Services guarentees that the Notary is familiar with the notarial duties involved in executing loan docuemnts. Furthermore we guarentee that the Notary will not offer any advice or take any actions that might concievably be construed as offering legal advice. Tucker Notary Services or the individual notary is insured by Errors and Omissions Insurance , proof of which is available upon request. We offer the physical and digital faciliies to print/copy documents and to scan and transmit the final executed product.
At Tucker Notary Services, we carry a $100,000 Errors and Omissions policy through Merchants Bonding covering all of our notary activity.
